SCOPE By ordering on KINGS-OF-FASHION.com you confirm the acceptance of the General Terms and Conditions of Business (GTC) between you and KOFAG International Fashion AG (subsequently called “KOFAG“ or “us”).
REGISTRATION In order to be able to buy in the on-line shop you need to register with some personal data. This information is protected under paragraph 15 GTC.
ORDER For orders you need to use the on-line shop of KINGS-OF-FASHION.COM. No orders can be taken via telephone, letter, FAX or E-Mail and thus will not be followed-up.
SHOP PRICES All prices in the on-line shop of Kings of Fashion are expressed in Swiss Francs (CHF) and all items in the ordering process will be invoiced in CHF. Possible exchange rate gains or losses are either in favour or to the loss of the client.
DELIVERY We deliver in all Switzerland, Liechtenstein as well as the European Union. Deliveries to all other countries are possible (Paragraph 6 GTC). Possible delivery costs will be shown while performing the ordering process. The goods will be directly delivered to the indicated delivery address. The delivery will take around 2 to 3 working days for deliveries within Switzerland and to Liechtenstein and 3 to 8 working days in the European Union and all other countries but some delays may be reserved in exceptional cases. It is not possible to form a claim for compensation due to delayed or omitted delivery. There is no delivery against payment option.
SHIPPING COST For all countries, the specific delivery costs will be indicated and added to the purchase price while in the ordering process in the on-line shop. With the confirmation of your order these delivery costs are accepted by you.
STOCK The availability of any article can be seen on-line on the internet site. Should any article not be available right now, you can leave us your e-mail address and will be informed as soon as this article is available again.
PAYMENT OPTIONS The payment is being done exclusively via Pay-Pal (www.pay-pal.com), VISA, MASTERCARD or pre-payment to the account of KOFAG International Fashion AG, 8006 Zürich, Account no. 1203713-81-1, IBAN CH39 0483 5120 3713 8100 1, at Credit Suisse, 8023 Zurich, SWIFT: CRESCHZZ80A. When performing a pre-payment, you always need to indicate the number of the invoice as a reference. This is the only guarantee for a swift treatment of your order. If the order is not paid within 7 days, it will automatically be cancelled.
GIFT VOUCHERS AND GIFT CODES Should your payment by a gift voucher or a gift code leave any balance, we shall credit this balance to your client account and it will be automatically taken into account upon your next order.
ACTION CODES Action codes are handled in the same way as gift vouchers. Action codes cannot be used on discounted items.
VALUE ADDED TAX (VAT) The prices in the on-line shop or in the shopping cart are binding. For delivery in Switzerland the VAT of 8 % VAT is already included in the shown price.For deliveries outside of Switzerland the Swiss VAT will be deducted. When receiving the goods, import tax (VAT and possibly customs) of the respective receiving country as well as possible customs clearance costs have to be paid by you. Depending on the receiving country, the relative custom duties and VAT rates are effective (e.g. 19% VAT in Germany). You have to bear these custom duties, VAT and custom clearance costs.For all ordered articles in the on-line shop of Kings-of-Fashion only the final price indicated on the order sheet, right before you confirm your order, is valid.
WARRANTY Please inform us in writing, within 14 days upon reception of the delivery, about any defects of material and/or manufacturing (paragraph 13 of the GTC) or by e-mail to returns@kings-of-fashion.com. When returning the defective items, they have to be clearly marked on the delivery note. We do not accept any responsibility for late notification of defects of material and/or manufacturing after the 14 days period.
RETURN POLICY Ordered articles can be returned to KOFAG within 14 days of the reception in the original packaging. No returns will be accepted for discounted articles. On part-deliveries, the refund date will be extended until the rest of the delivery is with you. We only accept intact, unworn and undamaged articles with the pertaining delivery note. The product authenticity TAG must be attached with the plastic security seal intact. We are entitled to keep part of the payment should we detect any responsibility of a deterioration of the goods by you. We shall determine that amount at our discretion. Any return of goods is to be paid by the buyer and the date of the postmark is binding for the acceptance of the return. In case of questions related to your return, please contact “returns@kings-of-fashion.com”. Return of your payment: The amount of the payment due to you will be returned in the same manner as you have executed the initial payment. RIGHTS FOR IMAGES AND TEXTS All rights to image, tone and text that are used on the on-line shop lies with KOFAG International Fashion AG or any of the respective partners. Any use in what-so-ever form is strictly prohibited without our prior consent or that of the possible partners.
DATA PROTECTION You are in agreement that your data is registered, edited and processed in the data base of KINGS-OF-FASHION.COM respectively their commissioned partner companies. At the same time you allow us to use your data for marketing purposes. Our on-line shop uses an analytics tool in order to optimize the customer’s behavior. You are entirely and personally responsible for your login data (incl. the password) and all the initiated orders with that information. Please do not share your login data with any third parties. Sensitive data will be securely transmitted with an encoded transmission (SSL). Your data will not be given to any unauthorised person.
APPLICABLE LAW AND JURISDICTION These General Terms and Conditions of Business and the use of the on-line shop is subject to Swiss Law.
